Appellate Litigation

Achieving a successful result at the trial court level or before a government agency, such as the U.S. Patent and Trademark Office, International Trade Commission or Food and Drug Administration, does not always end the matter. When necessary, Rothwell, Figg assembles a team of lawyers combining decades of experience successfully representing our clients’ interests in the regional courts of appeal and at the United States Court of Appeals for the Federal Circuit with appropriate technical know-how to address the complex legal and technical issues that arise in appellate practice. Our experience provides valuable insights into the law and deep understanding of the underlying technology that allows us to win cases on appeal, as appellant or appellee. The firm has represented clients in precedent-setting appellate cases, including pharmaceutical cases involving issues peculiar to the FDA and litigation brought under the Hatch-Waxman amendments.
