Elizabeth Leff Speaks on "How to Win Paragraph IV Patent Litigations on Behalf of the ANDA Applicant"
On September 30, 2003, Elizabeth Leff gave a presentation on "How to Win Paragraph IV Patent Litigations on Behalf of the ANDA Applicant" at a seminar entitled "Latest Thinking on Attacking/Defending Patents in the U.S. Pharmaceutical Market." Ms. Leff discussed a number of patent cases brought under the Hatch-Waxman amendments that have been decided in favor of generic challengers. Some of the topics covered by her presentation included the use of "paragraph IV" certifications versus "viii" statements, procedural methods for obtaining approval prior to expiration of the 30-month stay, techniques for disputing improper Orange Book listings, and antitrust and other counterclaims that may be asserted against NDA applicants. |
