Generic Drug Makers May Have an Easier Time Getting Their Products to Market
A recent decision by a D.C. federal court judge may allow generic drug makers to have an easier time getting their products to market. The March 2001 ruling came in a case involving Mylan Pharmaceuticals Inc. which produces a generic version of anti-anxiety drug, BuSpar (produced by Brisol-Myers Squibb Co.). Mylan, represented by Rothwell, Figg, argued that Bristol-Myers’s last minute relisting of its 20-year-old patent for an additional “method of use” was a strategic maneuver to improperly block Mylan from introducing its generic drug to the market. |
